Below is a copy of the complaint that I filed with the Consumer Financial Protection Bureau.
I received a student loan collection letter from Central Research, Inc. dated 03/02/2016. The letter lists monetary demands and states the following:
Further, the same letter also states what Central Research, Inc. fees are regarding this case.
This is all non-negotiable. I have no say in this. However, given that I dispute the validity of the debt, with this letter Central Research, Inc. is making an unconditional promise to provide financial services in the form or debt validation, which also qualifies as a contract.
In a letter dated 03/21/2016 I requested debt validation. Central Research, Inc. received this debt validation request on 03/23/2016 (USPS Delivery Confirmation EK654186145US).
I did not receive any response from Central Research, Inc. So, I repeated the debt validation request with a letter dated 04/18/2016. Central Research, Inc. received this debt validation request on 04/20/2016 (USPS Delivery Confirmation EK654186168US).
I asked Central Research, Inc. to furnish the requested information within 14 days of the receipt of the letter, that is, by 05/04/2016. Further, for each listed debt validation item for which the requested documents do not exist, I asked Central Research, Inc. to state separately that the requested documents do not exist.
I also informed Central Research, Inc. that if the company fails to furnish either the requested debt validation or confirmation that the requested documents do not exist, I reserve the right to hold Central Research, Inc. responsible for false advertising and breach of contract.
Again, I did not receive any response from Central Research, Inc.
Thus, Central Research, Inc.:
Accordingly, at the very least Central Research, Inc. should provide a formal letter of explanation.
Please investigate this case. Further, please inform me which other agencies and organizations supervise matters related to financial services, false advertising and breach of contract. I intend to file complaints with each such agency and organization regarding this case.
